Terms and Conditions

The following terms and conditions apply to the Schools First community initiative established by National Australia Bank Limited ABN 12 004 044 937, AustraliaCares ABN 35 114 280 376, The Foundation for Young Australians ABN 26 092 744 958 and Australian Council for Educational Research Limited ABN 19 004 398 145 (collectively 'Schools First').

When posting or providing Schools First with content (including stories), photos or comments (collectively 'Content') you agree to be bound by the following terms and conditions.

Schools First's rights

  1. Schools First retains the discretion (but not the obligation) to not use, edit, delete, reject or remove any Content which you post or seek to post on this website. Comments that are offensive, defamatory, unsuitable or breach other aspects of these terms will not be used or will be deleted.
  2. You grant Schools First a non-exclusive, royalty-free, perpetual, worldwide licence to reproduce, copy or use any Content you submit to us by all means whatsoever (including, without limitation, in print and electronic format). Such uses may include reproduction in advertisements promoting Schools First or on television.
  3. You consent to Schools First collecting and storing your IP address for security purposes or for Schools First to communicate with you about your Content.
  4. Your obligations

  5. You will not post any Content which breaches the confidentiality of any person or entity. You will not post any Content which constitutes Personal Information (as defined in the Privacy Act (1988) Cth) of any other person
  6. You will not post any Content:
    1. which is not original work in which you own the copyright, or which in any way infringes (or could reasonably be expected to violate or infringe) the copyright, trade mark or intellectual property rights of another person;
    2. which is (or could reasonably be expected to be) offensive, indecent or otherwise illegal;
    3. which is (or could reasonably be expected to be) defamatory of any person;
    4. is likely to offend, insult or humiliate others; or
    5. which you know or suspect (or ought reasonably to have known or suspected) to be false, misleading or deceptive.
  7. You will not post any Content for the purpose of:
    1. advertising or promoting any goods or services, or otherwise engaging in trade or commerce; or
    2. providing any financial advice, or advice of any kind
  8. Disclaimer

  9. The views which are expressed in the Content are not the views of Schools First or their related entities, and we accept no liability in respect of any Content posted, nor are we responsible for the Content and accuracy of the Content.
  10. Any reliance you place on the Content is done so at your own risk.
  11. Indemnities

  12. You agree to fully indemnify and hold harmless Schools First and their related entities against any liabilities, claims, costs, loss (including consequential loss) or damage suffered as a result of any material in the Content you post, as a result of any breach by you of these terms and conditions or caused by reason of your reliance on the Content.
  13. Notwithstanding any indemnity provided by you under these terms and conditions, Schools First and/or their related entities retain the right to assume the conduct of any defence to a claim brought against them, and you agree to provide all reasonable cooperation (including by making available relevant documents) that Schools First and/or their related entities may require from you in relation to any such claim, proceeding or appeal.
  14. Governing law

  15. These terms and conditions shall be construed and applied in accordance with the laws of Victoria, Australia, and you consent to the exclusive jurisdiction of the Victorian Courts to determine any matter or dispute which arises under these terms and conditions in accordance with the laws of Victoria, Australia.
